1. OVERVIEW AND ACCEPTANCE

Kong Restoration Services ("Kong Restoration," "we," "us," or "our") provides commercial flooring and restoration services across Miami-Dade, Broward, and Palm Beach counties in South Florida, and provides information about those Services through our website at kongsvc.com. These Terms apply to all visitors and clients. Specific projects are also governed by a separate written service agreement or contract that you sign before work begins. If there is a conflict between these Terms and your signed service agreement, the signed service agreement controls for that engagement.

2. ELIGIBILITY AND AUTHORITY

You must be at least 18 years old and legally able to enter into a contract to use our Services or request a quote. By requesting Services, you represent that you are the owner of the property, or that you are authorized to act on the owner's behalf, such as a property manager, association, or general contractor, and that you have the authority to approve work on the property.

3. OUR SERVICES

Kong Restoration provides commercial flooring and restoration services, including concrete surface preparation, industrial and commercial epoxy, polished concrete, parking garage restoration, waterproofing, concrete repair, terrazzo, and marble and natural stone polishing. Our services are limited to those covered under our professional license and insurance policies. For more information, please contact us. We reserve the right to decline or discontinue service for any project or client at our discretion.

4. QUOTES, ESTIMATES, AND PAYMENT

• Any quotes, estimates, or pricing we provide are based on the information available at the time and on a review of the project. Final pricing may change based on site conditions, project scope, materials, and other factors discovered during assessment or work.
• A quote is not a binding contract until confirmed in a signed agreement.
• Fees, deposits, and payment schedules are set out in your service agreement or invoice and are due as specified there.
• Payment may be collected through third-party payment processors. You agree to their terms when you submit payment.
• Additional work discovered or requested during a project may be handled through a change order and is your responsibility as agreed.

5. COMMUNICATIONS AND AI-ASSISTED TOOLS

By providing your contact information, you agree that we may contact you by phone, text, email, and chat, including through automated and AI-powered systems, for scheduling, service, and permitted marketing purposes. Calls may be recorded and transcribed as described in our Privacy Policy, and you may request a human representative at any time. You may opt out of marketing texts by replying STOP. Message and data rates may apply.

6. SMS MESSAGING TERMS AND COMPLIANCE

Program Description: Our messaging program sends quote and appointment confirmations, reminders, follow-ups, project updates, and customer support messages to clients who have booked or inquired about services with Kong Restoration Services through our website at kongsvc.com or via our scheduling and contact forms, and who have opted in to receive SMS notifications. Opt-in is collected via web forms with a dedicated checkbox for SMS consent.

Cancellation Instructions: You can cancel the SMS service at any time by texting STOP to the number that sent you messages. We will send a confirmation, and after that you will no longer receive SMS messages from us. To rejoin, opt in again as you did initially.

Carrier Liability: Carriers are not liable for delayed or undelivered messages.

Supported Carriers: Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, and most regional carriers.

Age Restriction: You must be 18 years or older to participate in our SMS program.

7. PHOTOS, VIDEO, AND MARKETING

We may take photos or video of the work we perform, including the condition of the property before, during, and after our services, for quality records, portfolio, social media, and marketing purposes. Unless you notify us in writing that you do not consent, you grant Kong Restoration Services permission to use images and video of the project and the work performed, without your personal identifying information, for these purposes. You may withdraw this permission at any time by contacting us, and any withdrawal applies to future use. For commercial properties, the final terms of what imagery and video may be used for marketing are determined by any prior signed agreements or contracts between Kong Restoration Services and the property owner, management company, or contracting party, and those terms take precedence over this section.

8. WEBSITE USE AND INTELLECTUAL PROPERTY

You agree to use our website lawfully and not to misuse it, interfere with its operation, attempt unauthorized access, or use it to violate any law. All content on the Kong Restoration Services website, including text, logos, graphics, the Kong Restoration name and marks, and photographs, is owned by or licensed to Kong Restoration Services and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our written permission.

12. FORCE MAJEURE AND SEVERE WEATHER

Kong Restoration is not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, severe weather, hurricanes, tropical storms, flooding, power outages, material shortages, or government orders. South Florida weather can affect project timelines, and we will communicate with you about any weather-related delays and reschedule work as conditions allow.

We may suspend or terminate your access to our website or Services at any time if you violate these Terms or if we determine it is necessary to protect the safety of people or property. Your payment obligations for Services already provided survive termination.

14. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Broward County, Florida, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Your continued use of our website or Services after any change means you accept the updated Terms.
